Legislation
Whilst it is not illegal to have Japanese Knotweed on your property, it is a controlled plant listed under the Wildlife and Countryside Act 1981. This places a responsibility on landowners to ensure that Japanese Knotweed is not planted or allowed to spread into the wild.
In situations where Japanese Knotweed is present and there is a risk of it spreading beyond the property boundary, enforcement action may be taken under the Anti-social Behaviour, Crime and Policing Act 2014. This can result in notices being served and, where reasonable steps are not taken to control the plant, potential fines or further legal action.
Engaging professional assessment and appropriate control measures helps demonstrate due diligence and reduces the risk of enforcement or civil disputes
